I have the honour to forward copies of a
despatch with its enclosures addressed to me by
His Excellency the Governor of Hongkong and also a minute on the subject by His Majesty's Acting
Crown Advocate with whose views I am in full
accord.
Mr. Mossop prefers not to attempt to draft the amendments of the China (Companies) Order in
Council that the adoption of the Governor's
suggestion would entail as these would depend on
the question raised in the latter paragraph
of his minute. It is, I think, evident that
His Excellency the Governor would not be in a
position to decide on the local securities to
be allowed as part of the required deposit and
that it would not be just to insist on these
being excluded in the case of China Companies.
The cash portion would presumably be with the
Hongkong Registrar, the other kept here.
As the revision of the Order in Council may
be imminent I hasten to submit the proposal.
